Applicable Law and Jurisdiction:

The MiddleastMovers.com website is controlled and operated from India. The terms of use shall be governed by the laws of India. Any legal disputes shall be subject to jurisdiction of courts in Delhi. Middleast Movers may pursue legal action in any jurisdiction to enforce its rights.

Cancellation and Refund Policy:

Cancellation Policy: Orders can be cancelled within 24 hours of placing, before shipment. No cancellation allowed after pickup/dispatch.

Refund Policy: For cancellations before shipment, please contact Customer Care on [helpline] for refund with supporting documents.

Pricing Policy: Rates depend on shipment volume, distance and extra services. Rates may change without notice.

Claim Policy:

Middleast Movers understands that damages may occur to household goods shipments during transit due to rough terrain, accidents, or other unforeseen events.

We strongly recommend our clients opt for risk coverage when booking their shipment with us. This will protect you from losses due to damage during transit. To avail risk coverage, a small additional charge will apply which can be paid via cheque. This coverage is advisable to avoid contingencies that may occur under unpredictable conditions.

Without risk coverage, Middleast Movers and its agents are exempted from any liability for loss or damage caused by accidents, fire, rains, collisions or other road hazards. For full protection, we recommend household goods are covered under Carrier Risk insurance by paying the Risk Coverage Value (FOV) charges.

Middleast Movers does not provide individual insurance policies or receipts. We will issue a Goods Consignment Note (GCN) under “Carrier Risk” as per Section 11 of the Carriage by Road Act, 2007. This GCN will serve as proof of coverage under our Carrier Risk policy.

The declared value of goods, noted in the packing list, will be the maximum liability. We therefore advise clients to declare reasonable values reflecting true replacement costs. Settlement of approved claims will correspond to declared value after applying depreciation on used goods as per policy terms.

To conclude, opting for Risk Coverage Value (FOV) charges at the time of booking is highly recommended for full protection from transit losses. Please declare accurate values and intimate claims promptly for smooth processing.

General Instruction:

Follow our general instructions for Clients:

  • Clients must record the proper value for each item in the inventory sheet. The inventory sheet will be treated as final for any claims settlement. Only the value in the Packing List will be considered for claim settlement.
  • Compensation will be restricted to the value declared by the client in the Packing List for that item.
  • The client must check and agree to the declared value of each item at the time of documentation.
  • No compensation will be paid for items not specifically listed in the Packing List with declared value.
  • Claims must be intimated in writing within 3 days of delivery, along with payment of full freight charges.
  • If a client signs the Proof of Delivery without any damage remarks, it is assumed goods were delivered in good condition.
  • Claims will be accepted only for items noted as damaged in Proof of Delivery.
  • No additional damage claims will be accepted after delivery is completed.
  • Clients must declare reasonable and realistic current values for old/used items. Declared value will limit maximum liability.
  • Intimate claims within 72 hours of delivery. For cars/bikes within 12 hours.
  • No claims will be accepted if a Risk Coverage waiver is signed.
  • No compensation for pre-existing damages was noted during packing.
  • No compensation for mental harassment, tension, or delay in delivery.
  • Repairs must be authorized to claim compensation.
  • No liability if the client arranges unloading/unpacking.
  • No claims are accepted if goods functioning was not checked before packing.
  • No liability for oil spills or prohibited items carried by the client.
  • Compensation is excluded for lift or wall damage during delivery.
  • No compensation for repair delays due to unforeseen circumstances.
  • No liability for delays due to weather, road conditions, or other factors.
  • Flowerpots or fragile items may be accepted without liability for breakage.
  • Clients must provide correct details and not include prohibited items.
  • Direct insurance cover by the client will invalidate compensation from the company.

For Cars, Bikes and Vehicles:

Special Instructions for Car & Bike Transportation:

  • Only external damages will be considered for cars/bikes. No claims for mechanical or internal faults.
  • No liability for damages to the engine, battery, AC, audio systems, etc. as functioning cannot be verified.
  • Cars/bikes are transported at the owner’s risk. Clients must take comprehensive insurance cover for transit.
  • The company will not be liable for any damages including accidents. But we will provide police complaints and other legal formalities.
  • For any transit damage claims, the client must directly contact their insurer.
  • If booked under the Owner’s Risk, we can only provide a damage certificate.
  • If Risk Coverage is taken, the company will cover the difference and NCB deductions claimed by the insurer.
  • NCB will be calculated for the current year.
  • New replacement parts will be adjusted for depreciation.
  • No claims accepted for internal damage to cars/bikes/electronics/electrical items.

We recommend clients take adequate insurance cover for cars and bikes. For any transit damage claims, please contact your insurer directly and provide our damage certificate. Our liability is limited under the Risk Coverage option.

Electronic Products:

Special Instructions for Electronic & Furniture Items are stated here:

  • No compensation for AC gas leakage or fridge refilling.
  • Claim for AC pipes as per declared value, if packed separately.
  • Repair estimates from authorized service center accepted up to declared value.
  • For repairable furniture damages, our carpenter will repair at no cost. Replacement not considered.
  • Minor scratches or dents to furniture not liable for claims.
  • No compensation if electronics not checked before packing. Only liable for repair to working condition or proportional cost of damaged part, not exceeding declared value.
  • For other items, compensation will be proportional to declared value or cost of repair.
  • For minor repairable damage, clients must submit repair quote from authorized service center.
  • If part of a set is damaged, compensation will be proportional value of that item as declared, plus 15% in exceptional cases. Complete replacement not considered.
  • Estimate must be submitted within 5-7 days. Compensation based on evident damage if estimate not received.
  • Depreciation of 10% per year applicable on declared value for electronic and furniture items.
  • GST only paid on submission of final repair bill.
  • If full declared value paid, damaged item becomes company salvage.
  • Fitting only provided free within 3 days of delivery.

In summary, compensation depends on declared value and extent of evident damage. We will repair minor damages. For major damage, compensation is proportional to declared value, depreciation, and salvage deductions as applicable.
